Refund Policy & Limited Warranty

Your complete satisfaction is our goal. If you need to return your GroBox or GroControl for any reason, our customer experience team is here to help!  Please note that we are constantly innovating and improving the designs and features of our products.  As such, your unit may differ aesthetically from the product images shown on our website.

Standard Refund Policy

Cloudponix, Inc. offers a money back guarantee for all orders placed on the Cloudponix, Inc. and Cloudponics.ca online store that are initiated within 15 days of when your order is placed.  We build your GroBox as part of a batch order so after 15 days your order fulfillment has begun with your funds being allocated towards the process of building your unit.  So unfortunately we can not accept refund requests after the 15 day period, please keep this in mind when ordering.

If you purchase your GroBox or GroControl from the https://lushplant.com website and your unit is not working properly your purchase is governed by our Limited Warranty — please see below.

  • If you purchased your GroBox or GroControl through one of our retail partners, please consult the retailer’s return policy or contact your point of sale to initiate a return.  We cannot accept returns for units purchased directly from our retail partners.
  • If it is has been more than 15 days since ordering your GroBox or GroControl but you just don’t want it anymore, then we cannot accept a return.

For cases approved under Warranty, shipping back the items must include ALL original packaging, products, parts, documentation and accessories in undamaged, like new condition.

The customer will pay the cost of return shipment to us.  We will pay the cost of shipping the replacement parts or products to you.

To initiate a Warranty Claim, please email us at contact@lushplant.com and include the following information:

  • Your order number;
  • The product(s) you are experiencing issues with; and
  • Details, images of the issue, etc. (we always welcome feedback!)

We will then provide you with a Warranty Merchandise Authorization (WMA) number as well as return instructions.

Once you receive your confirmation of shipment it will include a tracking # which will allow you to accurately track the exact delivery time of  your shipment – this can be handled directly with the shipping service once shipped.  **Please note all fulfillment and shipping delivery estimates you receive in communications from us are our best estimates and are subject to change as variables within our industry require or as extenuating circumstances may dictate.

Cloudponics Order Cancellation and Refund Policy

You can cancel your Cloudponics order for a full refund within 15 days of purchase.  After 15 days from time of purchase, our Standard Return Policy and Limited Warranty applies — please see above.

Limited Warranty

If you notice any issues with your GroBox or GroControl, please let us know ASAP so we can fix it as quickly as possible. Under our warranty policy (the “Warranty”), we will replace any part that fails within 1 year of delivery, excluding the pH and EC probes (which have a 6 month guarantee).

Pursuant to our Warranty, we promise that your GroBox or GroControl will be free from manufacturing defects at the time of sale, including all components for 1 year (except for the pH and EC probes, which are guaranteed for 6 months). At our sole election, we will repair or replace failing components or make a pro rata refund of the initial purchase price for the defective portion of the GroBox or GroControl.

Unfortunately we cannot honor this Warranty if you have modified your GroBox or GroControl in any way. We spent countless hours designing and engineering every tiny part of the GroBox or GroControl, so if you alter anything, it’s on you.

We also cannot honor this Warranty if you have not taken proper care of your GroBox or GroControl. We want to remind you that if you don’t take proper care of your GroBox or GroControl it may start doing things you won’t like, such as flood your home because roots clogged a pipe.  So give your GroBox or GroControl the attention it deserves or we cannot honor the Warranty.  Determinations that you have modified your GroBox or GroControl, or failed to maintain it properly, and have thereby voided the Warranty, will be made by us at our sole discretion.

To file a Warranty claim, please email us contact@lushplant.com and include the following information:

  • Your name;
  • Your address;
  • Your phone number;
  • A detailed description of the defect;
  • The purchase date; and
  • The delivery date.

THIS LIMITED WARRANTY CONTAINS IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.

Cloudponix, Inc. (“Cloudponics,” “Cloudponix, Inc.,” “we,” “our” or “us”) warrants to the owner of the enclosed product that the product purchased (“Product”) from ourselves, partners, distributors, resellers or affiliates will be free from defects in materials and workmanship for a period of one (1) year from the date of delivery following the original retail purchase (the “Warranty Period”). If the Product fails to conform to this Warranty during the Warranty Period, we will, at our sole discretion, either (a) repair or replace any defective Product or component; or (b) accept the return of the Product and refund the money actually paid by the original purchaser for the Product. Repair or replacement may be made with a new or refurbished product or components, at our sole discretion. If the Product or a component incorporated within it is no longer available, we may, at our sole discretion, replace the Product with a similar product of similar function. This is your sole and exclusive remedy for breach of this Warranty. Any Product that has either been repaired or replaced under this Warranty will be covered by the terms of this Warranty for the longer of (a) ninety (90) days from the date of delivery of the repaired Product or replacement Product, or (b) the remaining Warranty Period. This Limited Warranty is transferable from the original purchaser to subsequent owners, but the Warranty Period will not be extended in duration or expanded in coverage for any such transfer.

1. WARRANTY CONDITIONS; HOW TO MAKE A CLAIM UNDER THIS LIMITED WARRANTY
Before making a claim under this Warranty, the owner of the Product must (a) contact Cloudponix at contact@lushplant.com during the Warranty Period with a description of the alleged defect, and (b) comply with Cloudponix’ return shipping instructions. Cloudponix will have no warranty obligations with respect to a returned Product if it determines, in its reasonable discretion after examination of the returned Product, that the Product is an Ineligible Product (defined below). Cloudponix will bear all costs of return shipping to owner and will reimburse any shipping costs incurred by the owner, except with respect to any Ineligible Product, for which owner will bear all shipping costs.

2. WHAT THIS LIMITED WARRANTY DOES NOT COVER
This Limited Warranty does not cover the following Products that have been subject to: (a) modifications, alterations, tampering, or improper maintenance or repairs; (b) handling, storage, installation, testing, or use not in accordance with Cloudponix, Inc.’ documentation; (c) abuse or misuse of the Product; (d) breakdowns, fluctuations, or interruptions in electric power or the telecommunications network; or (e) Acts of God, including but not limited to lightning, flood, tornado, earthquake, or hurricane. Products that meet any of the conditions described in (a) – (e) above are referred to herein as “Ineligible Products.” This Limited Warranty does not cover consumable parts, including batteries, unless damage is due to defects in materials or workmanship of the Product, or software (even if packaged or sold with the product). Unauthorized use of the Product can impair the Product’s performance and may invalidate this Limited Warranty.

3. DISCLAIMER OF WARRANTIES
EXCEPT AS STATED ABOVE IN THIS LIMITED WARRANTY, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLOUDPONIX AND ITS DISTRIBUTORS, RESELLERS AND AFFILIATES DISCLAIM ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES AND CONDITIONS WITH RESPECT TO THE PRODUCT, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLOUDPONIX ALSO LIMITS THE DURATION OF ANY APPLICABLE IMPLIED WARRANTIES OR CONDITIONS TO THE DURATION OF THIS LIMITED WARRANTY. USE OF THE PRODUCT IS AT YOUR OWN RISK. THE PRODUCT IS NOT INTENDED OR DESIGNED TO MONITOR ANY INDIVIDUAL’S SAFETY OR HEALTH AND IS NOT A SUBSTITUTE FOR PROPER CARE AND SUPERVISION OF CHILDREN, THE ELDERLY, OR ANY OTHER INDIVIDUAL.

4. LIMITATION OF DAMAGES
IN ADDITION TO THE ABOVE WARRANTY DISCLAIMERS, IN NO EVENT WILL CLOUDPONIX AND/OR ITS DISTRIBUTORS, RESELLERS AND AFFILIATES BE LIABLE FOR ANY CONSEQUENTIAL, INCIDENTAL, EXEMPLARY, OR SPECIAL DAMAGES, INCLUDING ANY DAMAGES FOR LOST DATA OR LOST PROFITS, ARISING FROM OR RELATING TO THIS LIMITED WARRANTY OR THE PRODUCT, AND CLOUDPONIX’S TOTAL CUMULATIVE LIABILITY ARISING FROM OR RELATED TO THIS LIMITED WARRANTY OR THE PRODUCT WILL NOT EXCEED THE AMOUNT ACTUALLY PAID FOR THE PRODUCT BY THE ORIGINAL PURCHASER.

5. APPLICABLE LAW; CLASS ACTION WAIVER
This Warranty shall be deemed to have been made in, and shall be construed in accordance with, the laws of the State of California, and its validity, construction, interpretation and legal effect shall be governed by the laws of the State of California applicable to contracts entered into and performed entirely therein. You and Cloudponix, Inc. agree that the state and federal courts located in San Francisco County, California shall have sole and exclusive jurisdiction to adjudicate any dispute that may arise under this Agreement. You and Cloudponix, Inc. consent to venue, service of process and personal jurisdiction in the state and federal courts located in San Francisco County, California for purpose of adjudicating disputes arising under this Agreement. You and Cloudponix, Inc. waive any defense of inconvenient forum to the maintenance of any action or proceeding so brought and waives any bond, surety, or other security that might be required of any other party with respect thereto.

YOU WAIVE YOUR RIGHT TO PARTICIPATE IN ANY CLASS ACTION ARISING FROM OR RELATED TO THE WARRANTY.

ALL CLAIMS AND DISPUTES ARISING FROM OR RELATED TO THE WARRANTY MUST BE ADJUDICATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS BASIS, AND CLAIMS OF MORE THAN ONE CUSTOMER OR USER CANNOT BE ADJUDICATED JOINTLY OR CONSOLIDATED WITH THOSE OF ANY OTHER CUSTOMER OR USER.

5. YOUR RIGHTS AND THIS LIMITED WARRANTY
This Limited Warranty gives you specific legal rights. You may also have other legal rights that vary by state, province, or jurisdiction. Likewise, some of the limitations in this Limited Warranty may not apply in certain states. The terms of this Limited Warranty will apply to the extent permitted by applicable law. For a full description of your legal rights you should refer to the laws applicable in your jurisdiction and you may wish to contact a relevant consumer advisory service.

Terms of Use

You are responsible to use our products in a legal manner in line with the rules, by-laws and legislation for your city/town and your province/territory.  Cloudponics Canada, its partners, subsidiaries and affiliates, are not responsible for any misuse, abuse or damages caused by improper or illegal use of our products.

Any unauthorized use of our brand, trademarks, info or images may result in termination of your Agreement, cease-and-desist notification, and/or legal action as deemed appropriate at the sole discretion of the Company.
